1. Introduction

By purchasing from GoToMarketKits ("we," "us," "our," or "Company") and accessing our products and services, you confirm your acceptance of, and agree to be bound by, these Terms of Service ("Agreement").

2. Agreement to Terms of Service

This Agreement takes effect on the date on which you first purchase from or access GoToMarketKits.

By making a purchase, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree to these terms, please do not make a purchase.

3. License Grant and Product Description

3.1 License Terms

Upon purchase and payment, you are granted a non-exclusive, non-transferable, revocable license to download, use, and implement the automation templates ("Products") included in your purchase for your personal or business use only.

3.2 What You Receive

Each Product includes:

• Ready-to-import workflow templates (n8n JSON files, Clay worksheet exports, Google Sheets templates)
• Step-by-step setup guides (PDF documentation)
• Architecture diagrams and visual flow charts
• Demo videos (Loom recordings or similar)
• Free tier tool setup instructions

3.3 Permitted Use

You may:

• Download and import templates into your own n8n, Clay, or Google Sheets environments
• Customize and modify templates for your specific use case
• Use templates for your organization's internal automation needs

You may NOT:

• Resell, redistribute, or share the Products with others (outside your immediate team)
• Use the Products as a service offering to third parties without explicit written permission
• Claim ownership of or rebrand the Products as your own creation
• Reverse-engineer or attempt to extract proprietary methodologies

3.4 Termination of License

We retain the right to terminate your license without conditions, cause, or refund. This termination provision enables us to exercise control over product distribution and utilization.

4. Refunds and Returns

4.1 No Refunds Policy

Due to the nature of digital products, GoToMarketKits automation templates cannot be refunded, exchanged, or returned once access is granted.

Once you have downloaded or accessed your purchased Products, the transaction is final.

4.2 Why No Refunds?

• Digital products can be copied, shared, or redistributed
• We cannot verify product integrity after download
• Access to our templates provides immediate and permanent value
• Once templates are accessed, they cannot be resold or reclaimed

4.3 Exceptions (30-Day Guarantee)

We stand behind our products. If you purchase a Product and it does not work as described due to our error or omission within 30 days of purchase, please contact us at joel@gotomarketkits.com with:

• Proof of purchase
• Detailed description of the issue
• Screenshots or error logs

We will work with you to resolve the issue or provide a refund at our sole discretion.

4.4 What This Guarantee Does NOT Cover

• Issues caused by incorrect setup or user error
• Incompatibility with third-party tools due to API changes or deprecation
• Customization requests or feature additions
• Change of mind or dissatisfaction with the product

5. Disclaimer of Warranties

5.1 As-Is Provision

All Products are provided on an "as-is" basis without warranties of any kind, either express or implied.

We do not warrant that:

• The Products will meet your requirements or expectations
• The Products will be uninterrupted, error-free, or bug-free
• The Products will be compatible with all third-party tools or services
• Results from using the Products will be as anticipated

5.2 Excluded Conditions

All express and implied warranties or conditions not stated in this Agreement (including without limitation, loss of profits, loss or corruption of data, business interruption, loss of customers or leads, or loss of contracts) are excluded and expressly disclaimed to the extent permitted under applicable law.

This Agreement does not affect your statutory rights under UK consumer protection law.

6. Limitation of Liability

6.1 Liability Cap

InvisibleHustle LTD shall not be liable to you for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of business or customers
• Loss or corruption of data
• Business interruption
• Reputational damage
• Any other damages arising out of or related to your use of the Products

6.2 Maximum Liability

Notwithstanding any other provision in this Agreement, InvisibleHustle LTD's total liability to you for any claim arising from this Agreement shall not exceed the amount you actually paid for the specific Product that is the subject of the claim.

6.3 Force Majeure

InvisibleHustle LTD shall not be liable or deemed in breach of this Agreement for any delay in performance or failure to perform any of its obligations if the delay or failure was due to any cause beyond our reasonable control, including but not limited to:

• Third-party API changes or deprecation
• Service outages from n8n, Clay, Google, or other platforms
• Technical failures
• Acts of God

7. User Responsibilities

7.1 Your Responsibility for Use

You are solely responsible for:

• How you use the Products
• Any modifications you make to the templates
• Any content or data you input into the automation workflows
• Compliance with applicable laws and regulations in your use of the Products

7.2 Third-Party Services

Our Products integrate with third-party services (n8n, Clay, Google Sheets, etc.). You are responsible for:

• Complying with those services' terms of service
• Maintaining your own accounts and API keys
• Understanding and accepting any costs associated with those services

We are not responsible for:

• Changes to third-party APIs or services
• Downtime or issues with third-party platforms
• Costs incurred through your use of third-party services

8. Intellectual Property

8.1 Our IP

All workflow templates, documentation, diagrams, videos, and methodologies are the intellectual property of InvisibleHustle LTD and are protected by copyright law.

8.2 Your Content

You retain ownership of any data or content you create or input into the automation workflows. However, by using our Products, you grant us the right to use anonymized, aggregated data about workflow performance for product improvement purposes.

9. Price and Payment

9.1 Pricing

Prices are as listed on our website at the time of purchase. We reserve the right to change prices at any time.

9.2 Future Price Increases

As we continue to improve GoToMarketKits and expand our offerings, prices may increase. Early customers benefit from current pricing without future price surprises.

9.3 Payment Processing

Payments are processed through Gumroad. By completing a purchase, you agree to Gumroad's terms of service and payment policies.

We collect minimal data: your email address and purchase record. We use this solely to:

• Reverse-engineering or attempting to extract proprietary methodologies

We may modify, update, or discontinue Products at any time with or without notice. We are not liable to you for any such changes.

12.2 Terms Changes

We may update these Terms of Service at any time. Continued use of our Products after updates constitutes acceptance of the new terms.
