GoToMarketKits License Agreement

This License Agreement ("Agreement") is entered into between GoToMarketKits, operated by InvisibleHustle LTD, whose contact information is hello@gotomarketkits.com, and you, the purchaser ("Licensee"), regarding the use of the GoToMarketKits automation templates, workflows, worksheets, guides, and related digital products (collectively, the "Products") available at gotomarketkits.com (the "Website"). By purchasing, downloading, accessing, or using the Products, Licensee agrees to be bound by the terms and conditions of this Agreement.

1. Grant of License

1.1 Personal License

Subject to the terms and conditions of this Agreement, GoToMarketKits grants Licensee a non-exclusive, non-transferable, and non-sublicensable Personal License to use the Products for the following purposes:

• Create unlimited projects using the purchased templates
• Build and develop automation workflows for personal use or commercial use
• Modify and customize the templates to fit your specific needs
• Use the templates in client projects (if you are a consultant or agency)
• Integrate the templates into your own business operations

1.2 Team License

Subject to the terms and conditions of this Agreement, GoToMarketKits grants Licensee a non-exclusive, non-transferable, and non-sublicensable Team License to use the Products for the following purposes:

• Create unlimited projects using the purchased templates
• Build and develop automation workflows as part of a team
• Share the templates and code with other members of your team
• Use the templates across multiple team members' projects
• Modify and customize the templates for team-wide use

1.3 What You Own

Upon purchase, you own:

• The right to use the templates in your projects indefinitely
• The right to modify and customize the templates
• The right to create derivative works based on the templates
• Access to updates and new versions (if included in your purchase tier)

2. Restrictions

Licensee shall not:

• Resell or redistribute the Products as standalone templates, workflows, or worksheets
• Share or distribute the Products to third parties who have not purchased a license
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices from the Products
• Use the Products in any way that violates applicable laws, regulations, or third-party rights
• Sub-license, rent, lease, or transfer the Products or any rights granted under this Agreement to another party
• Create competing products that are substantially similar to the Products for resale
• Reverse engineer the Products for the purpose of creating competing products

What this means:

• You can use the templates in your own projects and client work
• You cannot sell the templates themselves as a product
• You cannot share the template files with others who haven't purchased
• You can modify and customize them for your needs

3. Ownership and Intellectual Property

GoToMarketKits retains all ownership and intellectual property rights in and to the Products, including but not limited to:

• The original template designs, workflows, and configurations
• The documentation, guides, and setup instructions
• The architecture diagrams and visual representations
• The brand names, logos, and trademarks associated with GoToMarketKits

This Agreement does not grant Licensee any ownership rights in the Products themselves. Licensee only receives a license to use the Products in accordance with the terms of this Agreement.

You own the projects you build using our templates, but you do not own the templates themselves.

4. Product Updates and Support

4.1 Updates

Depending on your purchase tier:

• Individual Products: You receive the version available at the time of purchase
• Pro Kit: Includes quarterly updates with new solutions based on community feedback
• Custom Kit: Includes lifetime updates to all solutions

4.2 Support

Support availability varies by tier:

• Individual Products: Self-service via documentation and guides
• Pro Kit: Email support for setup questions
• Custom Kit: 1-hour consultation call and 30 days implementation support via Slack

5. Warranty and Disclaimer

THE PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.

GoToMarketKits does not warrant that:

• The Products will meet your specific requirements
• The Products will be error-free or operate without interruption
• The Products will be compatible with all third-party tools or services
• The results obtained from using the Products will be accurate or reliable

Licensee assumes full responsibility for the selection, installation, use, and results obtained from the Products.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOTOMARKETKITS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE PRODUCTS, INCLUDING BUT NOT LIMITED TO:

• Loss of data or information
• Business interruption or loss of profits
• Cost of substitute products or services
• Errors or omissions in the Products
• Third-party tool compatibility issues

IN NO EVENT SHALL GOTOMARKETKITS' TOTAL LIABILITY EXCEED THE AMOUNT PAID BY LICENSEE FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

This limitation applies even if GoToMarketKits has been advised of the possibility of such damages.

7. Refund Policy

Due to the digital nature of the Products, GoToMarketKits automation templates cannot be refunded once access is granted. However, we stand behind our products.

If you purchase a Product and it does not work as described due to our error within 30 days of purchase, please contact us at hello@gotomarketkits.com with:

• Proof of purchase
• Details of the issue
• Steps taken to resolve

We will work with you to resolve the issue or provide a refund at our sole discretion.

8. Third-Party Tools and Services

The Products may require or integrate with third-party tools and services, including but not limited to:

• n8n (workflow automation platform)
• Clay (data enrichment platform)
• Google Sheets, Slack, CRMs, and other third-party services

Licensee is responsible for:

• Obtaining and maintaining accounts with required third-party services
• Complying with the terms of service of third-party providers
• Any fees or costs associated with third-party services
• Ensuring compatibility between the Products and third-party tools

GoToMarketKits is not responsible for the availability, functionality, or terms of third-party services.

9. Termination

This Agreement is effective until terminated. Licensee may terminate this Agreement at any time by ceasing use of the Products and destroying all copies.

GoToMarketKits may terminate this Agreement immediately if Licensee breaches any term of this Agreement. Upon termination:

• Licensee must immediately cease all use of the Products
• Licensee must destroy all copies of the Products
• All rights granted under this Agreement will immediately terminate

Sections 2, 3, 5, 6, and 10 shall survive termination of this Agreement.

10. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.

Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in England and Wales.

11. Entire Agreement

This Agreement constitutes the entire agreement between Licensee and GoToMarketKits concerning the subject matter herein and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral.

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

12. Modifications to Agreement

GoToMarketKits reserves the right to modify this Agreement at any time. Material changes will be communicated via email or prominent notice on the Website.

Continued use of the Products after modifications constitutes acceptance of the revised Agreement. If Licensee does not agree to the modifications, Licensee must cease using the Products.
